After over a decade of violating asbestos-related environmental laws and regulations, a Monterey contractor has been found guilty of violating such laws and was fined seven million dollars. The work being performed occurred in Monterey County at Carmel Valley Manor. The renovation work spanned from 1998 until 2013 with failure to survey for asbestos and notify the Monterey Bay Air Resources District (“MBARD”). In addition, the violations included failure to properly handle asbestos-containing materials during removal and disposal. The building owner was also fined $825,000.

Unfortunately, even though a contractor is not required to carry a Department of Occupational Safety and Health (DOSH) license for removing under 100 square feet of asbestos, it does NOT supersede the Cal/OSHA Asbestos in Construction Standard which still applies when removal or disturbance of ANY amount of asbestos containing material takes place during construction related activities.
